"Brick"

(Continued from page 21) the case of Structural Clay Products Institute vs. Crowe-Gulde Cement Co., in which the latter attempted to register a concrete brick as "Founder's Brick". In defense of "real" brick, SCPI cited an earlier 1956 ruling by the Federal Trade Commission, brought in a phalanx of testimony from respected professionals, and even invoked Funk and Wagnalls Dictionary.

In refusing Crowe-Gulde's application, the Trade mark and Trials Appeal Board laid down this ruling: "The question is not the breadth of the meaning of the word brick, but the meaning which the word would be likely to have to persons in the building construction and related fields.

"To such persons, the word brick signifies a structural unit made of fired clay or shale. (and) such being the case. the use of the word brick for a product made of another material (and not so identified) would be likely to mislead or deceive prospective purchasers of such goods into believing they are made of fired clay or shale."

Of what consequence is this to the public? SCPI Executive Director R. W. Otterson explains: "Since brick is such a widely known and used product, people draw immediate connotation from the word. To them brick means a host of things ranging from beauty to durability. When this reputation is "borrowed" by imitators, the buyer is deceived-especially if the imitation brick doesn't live up to the reputation of the real thing. This ruling protects both makers and buyers of brick."
