MCA of Oklahoma Gives Engineering Scholarship
A $500 scholarship was presented recently to R. Ken Jenner (center), a University of Oklahoma senior in civil engineering, by the Masonry Advancement Fund of the Mason Contractors Association of Oklahoma. Liability Exposure of Construction Manager
Bruce Jervis, writing in a recent issue of Construction Claims Monthly, says that despite the absence of clear-cut precedent, the liability exposure of the construction manager is usually directly related to the number of functions he assumes which are traditionally performed by the architect/engineer or general contractor.
Construction managers have found themselves liable for delay and disruption, design errors, cost overruns, erroneous progress payments and construction operations-all by not exerting sufficient care commensurate with their responsibilities, says Jervis.

"The simplest, most economical step a CM can take to minimize his liability exposure," Jervis concludes, "is to utilize a carefully drafted contract with the owner. In addition to specifically defining the nature and scope of the CM's responsibilities, the contract should indicate how these responsibilities interrelate with those of the other parties on the project."
