Builders Square Wins Jury Verdict Over Name
Builders Square, Inc., a chain of 83 do-it-yourself warehouse stores operating in 16 states, obtained a jury verdict on October 30, 1986, upholding its right to use the name Builders Square. The jury verdict resulted after a two-week trial in Texas State Court in San Antonio.
Builders Choice had sued Builders Square in 1985 claiming that consumers would be confused between Builders Square and Builders Choice. In affirming Builders Square's right to use its name, the jury found that Builders Square and Builders Choice were not confusingly similar to the average person.
"We are proud of our name Builders Square and we're happy that the jury recognized its uniqueness," said Jud Walford, executive vice president of Builders Square.
R. Laurence Macon of the law firm Cox & Smith, San Antonio, along with Richard E. Alexander and Marvin A. Tenenbaum of the law firm Alexander, Unikel, Bloom, Zalewa and Tenenbaum in Chicago represented Builders Square.
Radon Council Report on Home Safeguards
The Radon Information Council has reported on methods currently being developed to help safeguard homes from the potential hazards of radon gas exposure.
Radon, a radioactive gas formed by the natural decay of uranium in the soil, migrates through the cracks, utility and sump pump openings, and other passageways into the home and has been associated with lung cancer if inhaled in high doses over a long period of time.
"Researchers are now developing several relatively simple, inexpensive and commonly used remedies available that should reduce or eliminate the risks," said John Heslip, Council chairman.
New Movie on Lime for Hazardous Wastes
The National Lime Association has produced a new 16mm sound-color movie, "Taming a Hazardous Waste with Lime," which deals with the Chemical Waste Management hazardous waste site at Vickery, Ohio.
The movie shows how quicklime and cement kiln dust (3:1 ratio) were used to chemically fix and stabilize a pickle liquor sludge which contained organic contaminants. The lime-stabilized sludge will eventually be buried at the site, being placed between bottom and top lining systems. Leachates which pass through the landfill will be collected and disposed of, thereby protecting the groundwater in the area.
The movie (15 minutes long) is available in both 16mm and Super 8 for $175 and in ½ inch video for $75. Copies may also be borrowed by interested groups. Contact the National Lime Association for purchasing or borrowing the new movie, at 3601 N. Fairfax Dr., Arlington, VA 22201.
